1. Introduction
Welcome to NeutralServiceCrossing ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at neutralservicecrossing.sbs (the "Service") operated by NeutralServiceCrossing.
By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Service Overview
NeutralServiceCrossing offers luxury yacht charter services, which include but are not limited to:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Exclusive events
- Extended charters
All services are subject to availability and climatic conditions. We reserve the right to alter or halt services at any given time.
3. Booking and Reservations
3.1 Booking Process
In order to reserve a charter, you must:
- Be no younger than 18 years
- Provide truthful and complete details
- Submit the necessary deposit as detailed in your reservation confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
Your reservation is only guaranteed once payment is received and we send you a confirmation in writing. We hold the discretion to refuse service to anyone.
3.3 Availability
All charters are contingent on the availability of the vessel and favorable weather conditions. We will perform due effort to honor your requested dates and times.
4. Payment Terms
4.1 Pricing
All pricing is in € and comprises any applicable taxes unless stated otherwise. Costs are subject to modification without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the full charter cost due at time of booking
- Remaining balance: Must be paid 48 hours before the charter's departure
- Incidental expenses (if applicable): Payable upon completion of the charter
4.3 Payment Methods
We accept most major credit cards, bank transfers, and certified cheques. All payments are processed through secure, encrypted channels.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Over 72 hours before departure: Full refund minus transaction fees
- 24-72 hours before departure: Refund of 50%
- Under 24 hours before departure: No refund available
5.2 Weather Cancellations
If unsafe weather conditions are determined by our captain, options provided will include:
- A rescheduling of your charter to another suitable date without any extra cost
- A full refund if rescheduling is unfeasible
5.3 Mechanical Issues
In case of mechanical issues with your designated vessel, we will strive to supply a comparable replacement. If no substitution is feasible, we will issue a full refund.
6. Safety and Conduct
6.1 Safety Requirements
All individuals on board must:
- Heed all instructions from the crew
- Wear safety equipment as necessary
- Inform of any medical conditions that might affect their safety
- Stay within specifically designated areas on the yacht
6.2 Prohibited Items
The following items are forbidden on board:
- Glassware
- Illegal substances
- Firearms or any other weapons
- Excess non-alcoholic drinks (beyond reasonable consumption)
- Pets (unless permission is granted beforehand)
6.3 Conduct
Patrons are expected to behave in a considerate manner. A charter may be terminated prematurely without refund if passenger behavior endangers safety or interrupts the experience for other guests.
7. Liability and Insurance
7.1 Our Liability
Our accountability is confined to the amount paid for your charter. We are not liable for:
- Injuries sustained due to passenger negligence
- Loss or destruction of personal belongings
- Indirect, incidental, or punitive damages
- Delays due to weather or events beyond our control
7.2 Insurance Coverage
We keep comprehensive marine insurance that covers our vessels and activities. Passengers should arrange their own travel and personal insurance.
7.3 Assumption of Risk
By engaging in our charter services, you recognize that marine activities carry inherent risks and you accept responsibility for your personal safety and security.
8. Modifications and Itinerary Changes
We have the right to modify itineraries, paths, or schedules due to weather, safety, or operational demands. We will attempt to provide a similar alternative experience wherever possible.
9. Force Majeure
We will not be held accountable for interruptions, cancellations, or adjustments caused by circumstances beyond our scope, such as but not limited to:
- Extreme weather conditions
- Natural disasters
- Regulatory actions
- Port terminations
- Technical failures
10. Privacy and Data Protection
Your private data will be managed in line with our Privacy Policy. By utilizing our services, you consent to the collection and use of your data as outlined in our Privacy Policy.
11. Intellectual Property
All contents of our website, including text, visuals, logos, and pictures, are safeguarded by copyright and trademark laws. Reproduction, distribution, or creation of derivative works is prohibited without our express consent.
12. Governing Law
These Terms are regulated by the laws of France. Any disputes should be settled in the courts of Golfe-Juan, France.
